Is Weed Legal in Arkansas in 2026? Medical-Only Rules and the Visiting Patient Card

Missouri has adult-use. Oklahoma has an easy medical card. Arkansas still does not honor either one at the register. If you are driving the Ozarks this fall, here is what is legal, what is not, and how the 90-day visiting card actually works.

Every September the same search spikes in Arkansas: is weed legal here? Folks are booking cabins around Mountain View, driving in from Springfield or Tulsa, and assuming a Missouri adult-use package or an Oklahoma medical card will work at an Arkansas dispensary. It will not.

As of September 14, 2026, Arkansas is still a medical-only state under Amendment 98. Recreational cannabis is illegal. Home grow is illegal. Licensed dispensaries will not ring up an out-of-state card. The legal path for a resident is an Arkansas registry identification card. The legal path for a visitor is a separate 90-day Arkansas visiting patient card. Everything else is still a criminal matter under state possession law.

Why is recreational cannabis still illegal in Arkansas?

Voters approved medical cannabis in 2016. First legal sale was May 2019. Adult-use has not followed. Issue 4, the 2022 recreational initiative, failed with roughly 56 percent of voters against it. A December 2025 Arkansas Supreme Court decision (State v. Good Day Farm) held that the General Assembly may amend voter-initiated constitutional amendments by a two-thirds vote. That is a structural change worth watching, because Amendment 98 itself now sits in a different political posture than it did in 2016. Watching is not the same as assuming recreational is coming this fall. Until the law changes, the stores you see on Highway 9 and in Little Rock, Fayetteville, Jonesboro, and Hot Springs are medical dispensaries serving cardholders.

How does the 90-day visiting patient card work for fall travel?

Arkansas does allow out-of-state medical patients to shop. It does not do it by glancing at your home-state plastic. You apply online as a visiting patient at mmj.adh.arkansas.gov.

You must already hold a medical marijuana card (or equivalent) from another state, and the condition you were approved for at home must also be a qualifying condition in Arkansas. That second part surprises people. A condition that is good in Oklahoma is not automatically good here. The visiting card is $50, non-refundable, and lasts 90 days. Processing is up to 14 days after ADH has the complete application and payment. There is no temporary card. After approval you get an email, you log back in, and you print the card yourself. Visiting patients always print their own. Bring that printout plus photo ID to a licensed dispensary.

Do the math on a long weekend. If you apply on a Monday and drive down on Friday, you will probably be standing at the counter with an out-of-state card and a disappointed budtender. If you live here and you have been waiting on recreational, that is not a plan. The registry held 118,752 active cards as of September 12, 2026. The state fee is $50. First-time physician certification is in person with an Arkansas-licensed MD or DO. Renewals can use video telehealth. Possession without a card is still prosecuted. First-time possession of under four ounces is a Class A misdemeanor under the criminal code — up to a year and a $2,500 fine — which is a steep way to learn that “Missouri is right there” is not a defense.
